Over the last 6 months there have been significant legal developments – both new legislation and caselaw – concerning the benefit entitlements of EEA nationals. Further changes are expected over the coming months.

This webinar will cover:

  1. A report back from the Court of Justice hearing of the Northern Irish case (C-709/20) on the legality of excluding pre-settled status as a qualifying right to reside for universal credit (i.e. the same issue as in Fratila) and discussion of the ongoing relevance of these cases post 31 December 2020;
  1. Some of the key Withdrawal Agreement protections that affect benefit entitlements;
  1. Potential arguments and practical tips on how to advise EEA nationals at this time.

Rebecca Walker: Lead author of the Benefits for Migrants Handbook and CPAG Trainer

Tom Royston: Barrister at Garden Court North – has acted in numerous right to reside cases including SSWP v Gubeladze [2019] UKSC 31; Fratila and Tanase v SSWP and AIRE Centre [2020] EWCA Civ 1741 and also Counsel for the claimant in C-709/20 Department for Communities NI.

This two-hour webinar will run from 1pm to 3pm, with a 15 minute break at 1.55pm. It will be delivered live online, via Zoom, and there will be an opportunity for attendees to ask the speakers questions.
